These Terms & Conditions ("Terms") of (a) use of our website www.ridobiko.com ("Website"), our applications ("Application / App") or any products or services in connection with the Application/ Website/products ("Services") or (b) any modes of registrations or usage of products, including through SD cards, tablets or other storage/transmitting device are between "Ridobiko/Company/We/Us/Our" and its users "User/Customer/You/Your".

These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries guidelines) Rules, 2011 thereunder, as amended from time to time.

Please read the Terms and the privacy policy of the Company ("Privacy Policy") with respect to registration with us, the use of the Application, Website, Services and products carefully before using the Application, Website, Services or products. In the event of any discrepancy between the Terms and any other policies with respect to the Application or Website or Services or products, the provisions of the Terms shall prevail.

Your use/access/browsing of the Application or Website or the Services or products or registration (with or without payment/with or without subscription) through any means shall signify your expressed acceptance of the Terms and Your agreement to be legally bound by the same.

If You do not agree with the Terms or the Privacy Policy, please do not use the Application or Website or avail the Services or products. Any access to our Services/Application/products through registrations/subscription is non-transferable.

We hold the sole right to modify the Terms of Service without prior permission from You or providing notice to You. The relationship creates on You a duty to periodically check the Terms of Service and stay updated on its requirements. If You continue to use the Website/Application/Services/Products or avail any of its services without registration following such change, this is deemed as consent by You to the so amended policies. Your continued use of the Website/Application/Services/Products is conditioned upon your compliance with the Terms of Service, including but not limited to compliance with the Terms of Service even after alterations, if any.

Ridobiko provide two type of payment option to the customers:

1. Extra km charges :
   

   • For bike : ₹5/km
   • Scooter: ₹4/km

2. Late return :
   

   • Non Geared Scooters: First 2 hours of delay would be charged at ₹100 + more than 2 hr full day rent will be charged
   • Geared two wheeler: First 2 hours of delay would be charged at ₹200 + more than 2 hr full day rent will be charged
   • Post 2 Hours:, Above hourly charges will be applicable on weekdays (Mon–Fri)
   • On weekends (Sat-Sun) - Next 24 hour rental will be charged post 1 hours of late return.

3. Reschedule before start:
   

   • Modifications made within 24hrs before booking start time: Modification not accepted
   • Modifications made before 24hrs of booking start : Modification will be the subject of bike availability and customer request type. Ridobiko will have the sole discretion and authority to accept or reject the such modifications.

4. Fuel Policy(charges) :
   

   • When fuel is more than Ridobiko offered to customer - Ridobiko will refund the amount based on fuel policy.
   • When fuel is less than we offered to customer- Ridobiko will charge customer based on fuel policy.
   • Duration of refund – The refund will be processed in 3 - 4 working days.

1. Home delivery of the vehicle
   

   • Home delivery facility is available only in defined cities and available on demand to the users. Home delivery will depend on staff availability at the store
   • Below are the Home delivery charges from one side (Ridobiko store to User location or User location to Ridobiko store). Please note that distance will be measured from Ridobiko store to the user location
     • 0 to 2 KM: Rs 150
     • 02 to 04 KM: Rs 200
     • 04 to 06 KM: Rs 250
     • 06 to 08 KM: Rs 350
     • 08 to 10 KM: Rs 450
     • Above 10 KM, charges will be decided manually

2. Maintenance at the doorstep (Maintenance at any location other than Ridobiko authorized service center)
   

   • Ridobiko team handles vehicle maintenance and outside/third-party maintenance is subject to Ridobiko team's written communication & approval
   • Vehicle need to be maintained based on the vehicle maintenance cycle and the user will receive communication from Ridobiko team to visit Ridobiko service center. In case users want the vehicle to be maintained at their doorstep, There will be an additional cost that needs to be paid by the user. Cost includes resource & travel cost. Below will be the charges those need to be paid by the user:-
     • 0 to 2 KM: Rs 150
     • 02 to 04 KM: Rs 200
     • 04 to 06 KM: Rs 250
     • 06 to 08 KM: Rs 350
     • 08 to 10 KM: Rs 450
     • Above 10 KM, charges will be decided manually
   • Please note that distance will be measured from Ridobiko nearest service center

1. No show during pick - 100% rent amount will be deducted and only security deposit will be refunded (If paid in advance by customer)

2. Between 0 - 24 hrs before the pickup time - No cancellation & 100% amount will be deducted.

3. Between 24-48 hrs before the pickup time: 75% of total booking amount or total amount paid whichever is higher will be deducted

4. More than 48hrs before the pickup time: 50% of total booking amount or total amount paid whichever is higher will be deducted.

5. In the case of subscription bookings (With minimum tenure of 1 month), If the user wants to return the vehicle before promised date then penalties will be applicable which will be a combination differential amount between the actual rental amount for used tenure minus the rent paid for actually used tenure and Rs 500 as an additional penalty for breaking the subscription

1. Deposit refund - Deposit will be refunded within 2 working days

2. Cancelled booking refund - Refund will be processed within 3- 4 working days. Refund amount will be decided based on the cancellation policy. Further, 2% of booking amount will be charged and deducted as payment gateway charges.

1. If any customer want to extend the trip then customer has to inform ridobiko atleast 8hr before the end of the trip .

2. Trip extension depends on availability of vehicle.

3. If a customer extends the trip without informing and consent of the Ridobiko, then at the time of bike return the customer is liable to pay Rs. 500/- fine + Additional days rent.

1. For any damages incurred to an Ridobiko asset (the two-wheeler), the user will be held responsible for bearing all the charges up to INR ₹10,000.

2. For any damages incurred to an Ridobiko asset (the two-wheeler) amounting more than INR ₹10,000, the user is eligible to claim insurance to cover the charges that imply including the rental cost incurred during downtime period of the asset which is a time period otherwise utilized by another Ridobiko user.

1. Valid driving license to ride a motor-cycle with/without gear, depending on the Vehicle proposed to be hired, in India;

2. Original of address Proof such as passport/Adhaar Card/Voter ID which shall be obtained by Ridobiko’ staff at the time of Vehicle pick-up./ drop-off

3. In the event the documentation provided by a user is fake or invalid, the same would attract a penalty as detailed under clause 9.

4. As a mandatory policy, individual customers who have placed a booking are requested to show one of their original government verified ID proof such as Aadhar card, Voter ID card, Passport etc., as leverage during vehicle pick-up. No private organization's ID will be accepted for the same.

5. Goverment verified ID proof such as Aadhar card,Driving licence or Passport will be needed to be submit during pickup and will be returned at the time of booking completion.

1. Over speeding :- Initially two warnings will be given upon observation of over speeding by the Customer. Therefater, , then charged at ₹ 200 for overspeeding will be charged for 3rd time as penalty and . Bbeyond 3rd warning a Penalty of ₹ 1000/- will be is charged (over and above any government fines that may have been levied.

2. Overspeed limits are as under:-

1. Non Geared Scooters: 60km/hour

2. Geared bike :

1. Less than 150 cc : 70km/hour

2. 150cc to 200 cc : 80km/hour

3. Greater than 200 cc : 90km / hour

4. Traffic and parking violations :- full fine will be charged from by the customer

3. Misplaced key :- ₹500 for misplaced key

4. Helmet :- ₹ 500 / per piece

5. Returning the vehicle to the wrong location :-

1. ₹ 500/- if parked within the 5 km radius from the ridobiko store.

2. if more than 5 km Ridobiko will decide based upon the distance between vehicle and Ridobiko hub

6. Triple riding :- Ridobiko will not allow triple riding if in any case customer triple ride .Then the customer would pay a full fine of Rs 500.

1. The user warrants that he/she shall use the Vehicle in accordance with all applicable laws including but not limited to the Motor Vehicles Act, 1988 and amended Motor Vehicles Act, 2016 and all rules framed thereunder, and shall not use the Vehicle for, or carry out while using the Vehicle, any illegal or unlawful activities.

2. The user shall be responsible for all charges and costs incurred with respect to the Vehicle for the entire period of the reservation and until the Vehicle is returned in a manner acceptable to RIDOBIKO.

3. The User agrees to adhere to the km cap limit of RIDOBIKO. The Bikes have a km limit of 240km per day basis and the scooters have a km limit of 120 km per day basis.

The user agrees and acknowledges that RIDOBIKO prohibits the use of the Vehicle in the following manner:

• With more than two (2) people on the vehicle;

• Seating or accommodating pets on the vehicle;

• Under the influence of alcohol and/or drugs or other banned substances or consuming tobacco or tobacco products on the vehicle;

• For or in any kinds of race, contest or competitions, or stunts;

• Tampering with, disassembling or in any way altering the vehicle or any of its parts without prior authorization from RIDOBIKO on a need basis;

• Uncommon usage, irresponsible riding methods, overstressing and mishandling the motorcycles causing excessive wear of the vehicle parts and undue damage;

• For carrying any material which is not permissible or endanger the road safety or safety of customer or any third party

• To carry unlawful/ hazardous or prohibited material;

• Using the incorrect fuel for the vehicle;

• Commercial usage of any type deriving financial benefits;

• Attaching any external structures to our motorcycles causing damage to the vehicle or other vehicles/human beings/animals coming in contact with it;

• Any other inappropriate use of the vehicle.

• In the event of any traffic violation by you while using or involving the Vehicle and/or your driving license you shall notify RIDOBIKO of the same immediately. You acknowledge that you shall be liable to pay all fines/penalties associated with such traffic violation (including parking, speeding, riding without a helmet, cutting signals etc.), and RIDOBIKO shall have no responsibility with respect to the same.

• The rental of the Vehicle is a right specific to the user, and cannot be transferred or granted to any third party. In the event the Vehicle is operated by any third party, the same shall amount to a Penalty Event.

• Home delivery depends on resources and bike availability and will be provided at the sole discretion of the Ridobiko, the same shall not be claimed as matter of right and entitlement.

1. The User fully understands and acknowledges that operating or riding on a vehicle is an activity that has its own unique, inherent risks, and that serious injury or death could result from operating or riding a vehicle through no fault of his own. The User is voluntarily choosing to operate and/or ride upon the Vehicles.

2. By accepting the terms and conditions, the User expressly agree to assume the entire risk of any accidents, property damage or personal injury, including permanent disability, paralysis and death, that he/she might suffer as a result of him/her operating or riding on a Vehicle.

3. Without limiting the foregoing, the User assume all risks arising from the following: (i) the condition or safety of the Vehicles, any other equipment, or any roadways, premises or property; (ii) the repair or maintenance, or lack thereof, of the Vehicles or any other equipment; (iii) the use of, or failure to use, any safety devices or safeguards; (iv) the conditions, qualifications, instructions, rules or procedures under which any Vehicle is used; (v) the violation by me or by other operators or passengers of any Vehicles User Eligibility or Program Rules; (vi) any defective or unreasonably dangerous products, components or Vehicles (vii) the weather conditions during operation of any Vehicles and (viii) single and/or multi-vehicle accidents.

4. The User at the time of booking and riding declares not to be under the influence of alcohol, drugs, other illegal substances, or any medications that may impair his/her judgment or his/her ability to operate or ride on a Vehicles. The User agrees that he/she will not operate or ride on any Vehicles. while under the influence of alcohol, drugs, other illegal substances or any such medications.

5. The User agrees that he/she will not operate or ride upon any Vehicles. unless he/she have first examined and satisfied himself that the Vehicles. is in good operating condition, and that he/she fully understands how to operate and ride on that Vehicles.

6. The User agrees to operate or ride on each Vehicles safely, defensively and within the limits of the law and own abilities. The User agrees to comply with all Vehicles user eligibility and program rules.

7. The User also agrees to allow the company and their respective dealers to contact him/her at the address, telephone number and e-mail address provided below and gather additional information about the Vehicles and/or additional information about other goods and services in which one may be interested.

Prior to taking possession of the Vehicle, the user is advised to do a brief inspection and the vehicle, so as to point out any defect that may materially affect the usage of the Vehicle. In the event no such damage or defect is pointed out to the ridobiko staff at the time of taking possession. If any ,damage pointed out after taking the possession of the Bike, the same shall be deemed to have been caused during the time the Vehicle was in the possession of customer, and You shall be liable to pay fees towards such damages or other applicable fees, and ridobiko hereby reserves the right to suspend, or terminate your membership. Any scratches beyond one (1) millimetre in width and/or depth and two (2) centimetre in length shall be considered as “damage” for the purpose of this clause, in addition to any other visible or invisible defect, or any defect that affects the normal usage of the Vehicle.

Whenever you become aware of any damage or defect subsequent to taking possession that prevents the normal usage of the Vehicle, you shall intimate RIDOBIKO of the same immediately. Similarly, in the event of theft or damage to the Vehicle by a third party, you shall intimate Ridobiko immediately.

RIDOBIKO is not liable for the availability of preferred color of the two-wheeler at the time of booking confirmation. The bike images displayed on the application/website during booking are indicative and are subject to availability.

RIDOBIKO may terminate these Terms, or your access to the Services in the event of a breach of any of the provisions of these Terms by you, with or without prior notice. RIDOBIKO may also stop providing the Services to you, or all users when it is no longer practicable or feasible to do so. Otherwise applicable sections of the Terms shall survive termination. In addition to any termination rights, we reserve the right to enforce and prosecute any violations of these Terms.

You agree to defend, indemnify and hold harmless the Company, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) Your use of and access of the Vehicles, Application/Website/Services; (ii) Your violation of any term of these Terms or any other policy of the Company; (iii) Your violation of any third party right, including without limitation, any copyright, property, or privacy right; or (iv) any claim that Your use of the Vehicles, Application/Website/Services has caused damage to a third party. This defense and indemnification obligation will survive upo termination of services too.

In no event shall the Company, its officers, directors, employees, partners or agents be liable to You or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those claim arising out, of or in connection with, Your use of, or access to, the Vehicles, Application or website.

This Agreement shall be governed by the laws of India, and the courts of Delhi shall have exclusive jurisdiction with respect to any dispute arising hereunder and You hereby accede to and accept the jurisdiction of such courts.

According to Government under Section 185 of the Motor Vehicles Act, 2016 under Section 185, a motorist caught under the influence of alcohol exceeding the permissible limit which is 30mg of alcohol in 100ml of blood is liable to be charged and the vehicle will be ceased by the City Traffic Police indefinitely. Under this circumstance, the RIDOBIKO user will be charged with the asset cost and downtime period.

If at any time, the user exhibits any signs of intoxication during bike pick-up, RIDOBIKO is at complete liberty to cancel the booking and no amount will be processed for refund.

Under a bike ceased by City Traffic Police, RIDOBIKO will not be liable for any of the legal procedures set by the Court and the corresponding charges will be undertaken by the user himself. Under no circumstance, is RIDOBIKO will be held responsible for aiding the user.

If found intoxicated at the time of booking completion, the user will be further blocked from using RIDOBIKO services indefinitely.

1. If the user intends to cross state borders, he will be liable to cover the state taxes including penalties, if any.charged with. RIDOBIKO will not be held responsible in case the user has been penalized due to lack of state-entry invoice that is obtained after completing payment before entering another state.

2. Gearless two-wheelers like Honda Activa and such are strictly prohibited to travel inter-city under any circumstances including medical emergencies, personal issues or more. For any incidence outlined above, the user is liable to pay a penalty amount of ₹500/- at the time of two-wheeler return at the corresponding hub-station

You understand that while RIDOBIKO ensures that all its vehicles are maintained in the best manner, owing to the nature and amount of use, they may be prone to faults and breakdowns in rare situations. These vehicles are susceptible to breakdown once in a while owing to many uncontrollable situations. All breakdowns or incidents involving a Vehicle must be intimated to RIDOBIKO immediately, and we shall ensure a mechanic or other professional is assigned to rectify such defect, or a replacement is provided to you.

In the event of an accident leading to the damage of the Vehicle or any damage or injury to a third party and/or vehicle, You must immediately inform RIDOBIKO and i) fill out an official police report form; ii) provide an accident report to RIDOBIKO in the manner prescribed; and iii) provide the following information to RIDOBIKO :

1. Date, time, and place of accident;

2. The license plate numbers of any other vehicles involved;

3. The names, addresses, and driver’s license numbers of the persons involved in the accident, or the name, address, and driver’s license number of the owner of the vehicle (if he or she is not the driver);

4. The name, addresses, and phone number of witnesses, passengers, and any other involved persons, where possible.

5. Circumstances of the accident.

The User shall be responsible for the costs related to the repair, recovery, and loss of use of any Vehicle resulting from any such accident, to the extent that insurance cover does not provide for the same. The Uuser agrees and acknowledges that he/she shall be wholly responsible for all damages and costs arising from his/her failure to comply with these terms.

In the event of breach of any of the provisions of this Agreement, the User shall be liable to make good the damage caused to the Vehicle(s) and/or RIDOBIKO due to such breach. In the event of a breach of the any of the provisions, where the breach has criminal consequences, RIDOBIKO reserves the right to initiate appropriate criminal proceedings against the User, and where there are no criminal consequences with respect to such breach, RIDOBIKO shall be at liberty to levy such penalty as decided under the Fee Policy.

In the event of Your breach of these Terms, You agree that the Company will be irreparably harmed and may not have an adequate remedy in money or damages. The Company therefore, shall be entitled in such event to obtain an injunction against such a breach from any court of competent jurisdiction. The Company’s right to obtain such relief shall not limit its right to obtain other remedies.

Any violation by You of the terms of this Clause may result in immediate suspension or termination of Your Services apart from any legal remedy that the Company can avail. In such instances, the Company may also disclose Your PII if required by any Governmental or legal authority. You understand that the violation of these Terms could also result in civil or criminal liability under applicable laws.

The Company has the right to change modify, suspend, or discontinue and/or eliminate any aspect(s), features or functionality of the Application or the Services as it deems fit at any time without notice. Further, the Company has the right to amend these Terms from time to time without prior notice to you. The Company makes no commitment, express or implied, to maintain or continue any aspect of the Websites or Application. You agree that the Company shall not be liable to You or any third party for any modification, suspension or discontinuance of the Application/Services. All prices are subject to change without notice.

Notice: All notices served by the Company shall be provided via email to Your account or as a general notification on the Application. Any notice to be provided to the Company should be sent to contact@ridobiko.com.

Entire Agreement: The Terms of use, along with the Privacy Policy, and any other guidelines made applicable to the Websitw/Application/Services from time to time, constitute the entire agreement between the Company and You with respect to Your access to or use of the Application, Website and the Services thereof.

Assignment: You cannot assign or otherwise transfer Your obligations under the Terms, or any right granted hereunder to any third party. The Company’s rights under the Terms are freely transferable by the Company to any third parties without the requirement of seeking Your consent.

Severability: If, for any reason, a court of competent jurisdiction finds any provision of the Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect.

Waiver: Any failure by the Company to enforce or exercise any provision of the Terms, or any related right, shall not constitute a waiver by the Company of that provision or right.

Relationship: You acknowledge that Your availing services of the Company, does not make You an employee or agency or partnership or joint venture or franchise of the Company.

The Company provides these Terms so that You are aware of the terms that apply to your use of the Website/Application and Services. You acknowledge that, the Company has given You a reasonable opportunity to review these Terms and that You have agreed to them.

Any feedback You provide with respect to your experience shall be deemed to be non-confidential. We shall be free to use such information on an unrestricted basis. Further, by submitting the feedback, You represent and warrant that (i) Your feedback does not contain confidential or proprietary information of You or of third parties; (ii) the Company is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) You are not entitled to any compensation or reimbursement of any kind from the Company for the feedback under any circumstances, unless specified.
